The following document provides information about the Terms of Payment of ClassClap Please carefully read the document to understand both your and our rights and responsibilities.

By purchasing packages on ClassClap, you consent to our communication with you via electronic means for any important information related to your purchase transactions or account.

Protecting the privacy of your financial information is of utmost importance to us. Please review to our Privacy Policy for further insight into the information we disclose, information we do not disclose, and our methods for safeguarding your data.

 1. Definition

For the purposes of this Payment Policy:

– “Account” means a unique account created for accessing our Services or any part thereof.

– “Company” (referred to as “Company,” “We,” or “Our” in this Agreement) is VJA PLUS SOFTWARE JOINT STOCK COMPANY, tax code: 0108702050.

– “You” and/or “User” means an individual accessing or using the Services, or a company or other legal entity on behalf of which such individual is accessing or using the Services, as applicable.

– “ClassClap” is a classroom management app, attendance tracking, academic progress evaluation, and information exchange between parents and teachers, aimed at connecting schools, teachers, and students’ parents. ClassClap includes: website: https://classclap.vn, ClassClap app on Apple App Store, or Google Play Store.

– “Payment Method” means the current, valid payment method accepted through the payment gateway: VNPay, PayPal, Apple Pay, Google Pay. Payment methods may be updated and adjusted.

– “Payment Gateway Partner” is the Company’s partner acting as an intermediary connecting the Company with banks, allowing customers to use bank cards/bank accounts or e-wallets to pay Service Fees to us.

– “Service and Utility” means one or more or all services and utilities in ClassClap for which you must pay a fee to use.

– “Service Fee” is the fee you must pay when registering to use Services and Utilities on ClassClap according to the current price list.

2. Payment Conditions

You agree that when making payment for ClassClap Services and Utilities, you meet the following conditions:

– Age: from 18 years old and above.

– Bank Card/Bank Account: You are the cardholder/bank account holder or you are authorized by the cardholder/bank account holder to use or own it.

3. Payment Method Selection

– For ClassClap on computer (or web version): You can choose VNPay or Paypal payment gateway. In case of international payments, choose the Paypal payment gateway.

– For ClassClap on mobile (or app version): You will pay directly through the Apple Pay or Google Pay payment gateway, respectively.

4. Payment

To access and be granted permission to use the Services and Utilities on ClassClap, you must authorize ClassClap (and our Payment Gateway Partner) to calculate all Service Fees you must pay corresponding to your usage needs and fees through the Payment Method you choose to conduct transactions. You acknowledge and agree that you have the legal right to use that Payment Method, and all information you provide to us (or our Payment Gateway Partner) is accurate, current, and complete. You also allow us to collect and store that Payment Method, along with other related transaction information; however, ClassClap will not directly store any credit card account numbers.

5. Renewal

• Services and Utilities may include automatic periodic payments for Service Fees you have subscribed to (“Subscription Services”). If you activate Subscription Services, you and we understand that you authorize ClassClap to charge periodic fees, on an ongoing basis and until you cancel the automatic renewal or your account, all amounts accrued on or before the due date for your accrued amounts cannot be paid.

The payment period (T) is calculated from the date of your first payment to the corresponding end date according to the subscription period you have registered for. The next payment period (T+1) will automatically renew and charge fees on the first day of that payment period.

• ClassClap will notify Users of any price increases or changes to Subscription Services (such notification may be made through any reasonable means such as the website www.classclap.vn and/or social media platforms: Fanpage, Facebook, Zalo, Email, SMS). If you do not want to accept the price changes, you may cancel your Subscription Services as directed. If you do not cancel your Subscription Services after the effective price change and before the start of the new subscription period, your Subscription Services will be renewed at the effective price at the time of renewal without any additional action on your part, and you authorize us to charge your Payment Method for these amounts. Registration will continue until you cancel your subscription or we terminate it.

6. Cancellation of Renewal

You must cancel your Subscription Services before the renewal to avoid being charged the next periodic Subscription Fee to your account. You can cancel your Subscription Services, including automatic renewal, by following the instructions. If you cancel your Subscription Services or Services and Utilities, you can still use them for the period you have paid for.

7. Payment Information Update

You are responsible for updating your payment details and Payment Method by changing the details in your account settings. When your details change or are about to expire, we may take or receive payment from your payment with the condition that the updated payment details include the card number, expiration date, and card verification code (CVV/CVC or equivalent). This allows us to continue providing you with access to the Subscription Services or Services and Utilities. You authorize us to continue charging your chosen Payment Method using the updated information.

8. Sharing

You acknowledge and agree that any credit card information as well as related invoice and payment information you provide during the purchase of Services and Utilities may be shared with ClassClap payment processors for the sole purpose of transaction processing.

9. Exclusion of Liability

If payment by your debit card results in an overdraft or other fee from your bank, in this case, you will be responsible for that fee, and we shall be exempt from liability in this regard. If your payment method fails or your account is overdue, (i) you agree to pay all amounts due on your account upon request, (ii) ClassClap may collect outstanding fees using other collection mechanisms (which may incur fees for alternative payment methods in your profile with us), (iii) ClassClap reserves the right to suspend or terminate your account with ClassClap, including deleting your account from ClassClap. You are responsible and agree to indemnify ClassClap and all damages, claims, fees, penalties, fines, and other legal responsibilities that we incur from your actions or arise from payments that you have authorized or accepted.

10. Processing Failure

In the event of a failed payment transaction, we will notify you, and in cases where your transaction fails but you are still debited, we will refund the money within 14 working days. If the deadline passes and you still do not receive the refund, please contact us immediately for prompt resolution via email at support@classclap.vn or hotline: 096.141.0108.

11. ClassClap’s Rights

• We reserve the right, with or without prior notice, to limit the availability or discontinue any part of the Services and Utilities; to upgrade, improve, or adjust the Services and Utilities for any discount vouchers, discount codes, promotional codes, or similar promotions.
• We may cancel any transactions or delay payments for a period or support/sponsor tools for transactions or restrict your transaction if we believe that the transaction violates the terms of this Payment Policy or any terms you agree to, commit to us, or publicly post at ClassClap, or if we believe doing so may prevent financial loss.
• We have the right to temporarily suspend or restrict your access, use of our Services and Utilities until you terminate the violating behavior and/or remedy the consequences upon our request. If you do not terminate the behavior and/or fail to remedy it as required by us, we have the right to delete/terminate your account.
• We have the right to delete/terminate your account and not refund the Service Fee you have paid but have not used due to your violation of any terms at ClassClap.

12. Security Assurance

The information you provide or the data we (Payment Gateway Partners) collect regarding your payment, we (Payment Gateway Partners) only use for payment purposes, not for storage, or use for any other purposes.

• The transaction security policy at ClassClap applies to you: ClassClap does not directly store User card information, which is entirely encrypted by Payment Gateway Partners. Payment card information security for Customers is implemented by Payment Gateway Partners.

    – Payment Gateway Partners ensure compliance with security standards such as:

        + User financial information will be protected during transactions using SSL (Secure Sockets Layer) protocol.

        + Payment Card Data Security Standard (PCI DSS) certification provided by Trustwave.

        + One-time passwords (OTP) sent via SMS to ensure account access is authenticated.

        + 128-bit MD5 encryption standard.

        + Principles and regulations of information security in the banking and financial industry as regulated by the State Bank of Vietnam.

    (Note: The above security policies may be adjusted, supplemented by the provider/Payment Gateway Partners).

13. Amendments, Additions

We may update, modify the Payment Method at any time. Modifications will take effect immediately except for current Users, significant modifications will be notified or posted on the ClassClap system and will take effect from the date specified in the notice. We may require you to accept the modified Payment Policy to continue using the Services and Utilities. If you do not agree to the modified terms, you may be restricted from Services and Utilities and/or payment capabilities. Disputes arising from the Payment Policy will be resolved based on the version of this Payment Policy at the time the dispute arises

14. Resolution

Any disputes arising from this Payment Policy shall be resolved under the laws of the Socialist Republic of Vietnam.

In the event of any conflict between any translations in this Payment Policy, the Vietnamese language shall prevail.
